The Ex-Files: Can I get my ex to pay half our daughter’s orthodontic work?

My husband and I separated several years ago. We have two daughters, aged 11 and 13. Recently my ex-husband and I have been at loggerheads regarding two issues affecting our 13-year-old, Zara: whether she should have braces (and who should pay), and whether we should allow her to get a small tattoo on the back of her shoulder.

Question: Zara’s top teeth are crooked. She has become self-conscious about this and she now smiles with her mouth closed. My ex-husband thinks crooked teeth are a minor cosmetic issue and braces are unnecessary. Unsurprisingly, he is unwilling to contribute to the cost of orthodontic treatment. As a single mother I do not have the funds to cover the cost on my own. Can my ex-husband be required to pay half?

In regards to the tattoo, Zara has been persistently asking for permission for nearly a year. I am not thrilled at the prospect, but it would be a very small tattoo of her favourite instrument (a piano) in a spot that is usually covered by clothing. She has saved money from her newspaper run that she could use to fund it. Again, my husband is totally opposed to the tattoo. He says she is too young.

Braces

Whether your daughter should have braces to straighten her teeth is a guardianship decision. As you and your husband are both joint guardians, you will need to reach agreement on this issue before proceeding with treatment. If you cannot secure your husband’s agreement (preferably in writing), you will need to seek permission from the Family Court.
