When a relationship ends, one person may need financial support from their ex-partner or spouse to cover living expenses while they get back on their feet. Spousal maintenance is to be paid to the financially weaker party if they cannot meet their “reasonable needs” and the other person can afford to assist them. While it is referred to as “spousal” maintenance, the law confirms that de facto partners are also able to bring a claim. It's expected that after a reasonable amount of time both parties will be responsible for meeting their own living costs.
Spousal maintenance is usually obtained via agreement of the parties through their lawyers or from applying to the Family Court. It is also useful to look at bank statements over the last 12 months to make sure all expenses have been included.
